On 22 November 2024 the Supreme Court struck down the National Lottery Act in its entirety and handed betting to the states. Two years on, the consequences are still working through the market, and in October 2026 Lagos gave telecom operators thirty days to cut off unlicensed betting firms. If you bet in Nigeria, the licence that matters is your state one.

In Attorney-General of Lagos State v Attorney-General of the Federation, suit SC/1/2008, a seven-judge panel ruled unanimously that the National Lottery Act 2005 was unconstitutional in its entirety. Lottery, betting and gaming are residual matters, meaning they fall to state legislatures alone. The court issued a perpetual injunction restraining the federal government and its agencies from enforcing the Act in any state of the federation.
An attempt to claw the power back, the Central Gaming Bill 2025, passed both chambers of the National Assembly but did not receive presidential assent. The president declined on the ground that gaming remains a residual state matter and that federal competence over telecommunications does not extend by implication to online gaming.
The National Lottery Regulatory Commission has not vanished, but its role is now effectively confined to the Federal Capital Territory, where the FCT Authority has set up its own lottery regulatory office covering sports betting and interactive gaming. Commentators disagree on whether the Commission survives at all; we are not going to pretend that is settled.
The states do. More than twenty of them formed the Federation of State Gaming Regulators of Nigeria, and on 7 May 2025 in Lagos they adopted a reciprocity framework built around a Universal Reciprocity Certificate, administered by the federation secretariat. Its scope is deliberately narrow: online sports betting, online casino, online public lottery and promotional competitions.
Transitional operators paid no licence fees for 2025; normal renewal fees and regulatory charges resumed on 1 January 2026.
The gap worth knowing about: a meaningful number of states never joined the federation and have neither adopted reciprocity nor built a regime of their own. In those states the certificate has no legal effect and the position is simply unclear.
In Lagos, the Lagos State Lotteries and Gaming Authority licenses under the 2021 state law, with separate categories for sports betting, casino, lottery operator, gaming machines, pool betting and promotional permits. It publishes a public list of licensed operators with start and end dates, which is the single most useful page for a Lagos player. Check the end date before you trust an entry: the list is a snapshot and some have lapsed.
In October 2026 the Lagos authority notified telecom operators and value-added service providers that an NCC licence does not cover facilitating betting inside the state. It gave them thirty days to verify that every betting company on their platform holds a Lagos licence, and to suspend the ones that do not.
That is a meaningful shift. Enforcement aimed at carriers and payment rails reaches players far faster than enforcement aimed at offshore websites. If an operator you use loses access to USSD short codes or airtime billing in Lagos, you will notice before any court case concludes.
Nigerian betting runs on instant bank transfer, cards and USSD rather than on a single mobile wallet. NIBSS Instant Payment underpins the great majority of interbank transfers; it processed around 11.2 billion transactions in 2024. NIBSS is now rolling out a National Payment Stack intended to replace it, with NIP to be decommissioned once migration completes. Flutterwave, Paystack and OPay are the gateways most commonly sitting between a bookmaker and your bank.
One correction worth making, because it circulates widely: we found no Central Bank of Nigeria circular prohibiting or restricting gambling-related payments. The 2020 episode in which the CBN placed a no-debit instruction on dozens of accounts, some belonging to betting firms, was a foreign-exchange enforcement action, not a gambling one. We are not claiming a ban exists and we are not claiming one does not; there is simply no document.
The naira traded around 1,332 to the US dollar on the mid-market on 22 October 2026, with the official rate near 1,335 and the parallel market around 1,390 — a spread of roughly 4%. That gap, rather than any single day of volatility, is what moves the number.
A withholding tax of 5% on winnings was introduced from 1 January 2025 under the 2024 withholding tax regulations. The Nigeria Tax Act 2025 was signed on 26 June 2025 and took effect on 1 January 2026; it lists prizes and winnings among a person taxable income categories.
What we could not establish is how the new Act carries over, modifies or replaces that 5% rate from 2026 onwards. No Nigeria Revenue Service notice confirming the position turned up.
